These terms apply to your use of The First Step Habit Tracker (the "Service"), operated by [Your legal business name] ("we", "us"), established in Belgium. By creating an account or continuing to use the Service, you agree to these terms. If you are using the Service on behalf of an organisation, you confirm you may bind it; if you use it as an individual, you confirm you are of legal age in your country.
What the Service is
The First Step Habit Tracker is a web app for tracking small daily habits over a 30-day challenge, with reflections, a progress dashboard and exports. A free plan covers the full 30-day challenge. A paid plan, First Step Premium, adds personal habits, your full history beyond the current challenge, the Circle of followers and connected apps.
Your account
Give accurate details and keep them up to date. You are responsible for keeping your password confidential and for everything that happens under your account. Tell us at support@thefirststephabittracker.com if you think someone else has access.
Acceptable use
You must not use the Service to:
- break the law, or help anyone else to;
- commit fraud, send spam, or impersonate another person;
- infringe anyone's intellectual property or privacy;
- interfere with security — uploading malware, probing or scanning our systems, scraping, or circumventing technical limits;
- reverse engineer, resell or redistribute the Service.
Our intellectual property
We own the Service and everything in it — software, design, content and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have chosen. Your own habit entries, notes and saved quotes remain yours; you grant us only the limited permission needed to store and process them so we can provide the Service to you.
Service level
We work hard to keep the Service running, but we cannot guarantee it will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Payments, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing frequency, renewal, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Premium plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from the Billing page in the app; your access continues until the end of the period you have already paid for.
Suspension and termination
We may suspend or end your access if you materially breach these terms, do not pay, create a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. Where reasonable we will contact you first. You may close your account at any time. After termination you can ask us to export your data for 30 days, after which it may be deleted.
Liability
Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law. Otherwise our total liability is capped at the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost profits, data or goodwill. You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
Changes, law and contact
We may update these terms; material changes will be announced in the app. These terms are governed by the laws of Belgium, and its courts have exclusive jurisdiction, without affecting mandatory consumer protections in your country of residence. You may not transfer your rights under these terms; we may transfer ours as part of a merger or acquisition. Questions: support@thefirststephabittracker.com.
